Q - Is employment screening and vetting legal?

A - The short answer is... YES!

However it is important to stress that we only undertake employment screening with the candidate’s prior consent and full cooperation where they understand the repercussions of falsifying employment application information. We do not and will not provide any type of covert background checks on individuals – this is the realm of the Private Investigator.

Q - What is Staff Fraud?

A - There are various types of Staff Fraud that can be perpetrated against employers by employees and indeed by applicants. Staff Fraud can be pre-planned and even linked to organised crime or terrorist financing, whilst other fraud can be far more opportunistic and purely be for personal financial or material gain.

Staff Fraud can largely be classified under the following headings:

- Employment Application Fraud (i.e. counterfeit ID documents, fake certificates, false references, concealed criminal background, undisclosed adverse financial background)

- Theft of Personal Information (i.e. customer data)

- Theft of Commercial Data (i.e. industrial espionage)

- Account Fraud (i.e. fraudulent withdrawls and transfers)

- Theft (i.e. equipment, cash, goods or property)

- Manipulation of Information (i.e. expense claims, reward schemes, transaction fraud)

The full extent of the costs to your business are unlikely to ever be known, but by ensuring that appropriate measures such as screening new employees and vetting your workforce is undoubtedly the most effective way of preventing staff fraud from being perpetrated.

Q - Is pre-employment screening a legal requirement in the UK?

A - For employers within certain industries vetting and screening is indeed a legal and regulatory requirement. However there is a legal requirement for ALL UK employers to ensure that staff have the right to work (RtW) in the UK before they commence employment and that their eligibility to work status is maintained for those employees who are unable to demonstrate indefinite leave to remain (and work) in the UK. Failure to comply with this fundamental requirement has cost UK employers millions of pounds in UKBA fines for hiring illegal workers, not to mention the significant numbers of arrests and deportations.

VSG Verify can assist in ensuring that your staff can demonstrate their employment eligibility and provide reports which include checks of their identity documents and a system for retaining copies which is another part of the employer’s responsibility. VSG’s on-line system will also alert you in good time when repeat RtW checks are required.

Q - Will pre-employment screening put off applicants from applying for roles within our company?

A - Studies have shown that implementing a pre-employment screening programme can have the effect of reducing the number of applicants by as much as 10%. This can only be a good thing as those people wishing to obtain employment by deception will look elsewhere to find an easier target. Those with nothing to hide have nothing to fear and should indeed be pleasantly reassured by your company’s diligence in reducing risk to staff as well as to the business.

Q - My HR department do our screening, why should I outsource this to VSG Verify?

A - Many firms have found that it is an inefficient use of their time and resources to attempt to perform an ad hoc task that a specialist such as VSG Verify can do efficiently and cost-effectively. Q - How long does employment screening take?

A - This depends completely upon the level of screening required. Many firms opt for a 2-tier screening process whereby employees can start work upon successfully passing an initial package of background checks. These low cost and speedy checks allow urgent positions to be filled without delay, whilst permanent positions will be subject to successful completion of the full screening.

Many checks can be completed within 24 hours, whilst employment references, academic background and criminal record checks can take as much as two to three weeks to complete.

Q - I employ many temporary workers and the agencies screen them all for us, so why should I look at VSG Verify?

A- Agencies are often contractually obliged to screen your temporary employees, but if you are using more than one supplier you may find the standards of screening are of differing quality. From our experience as screening auditors we have found that agencies often have a tendency treat screening as a tick-in-the-box exercise, gathering data from the easiest sources (i.e. collecting references directly from the candidate) in order to expedite the checks, rather than obtaining verification direct from unbiased sources.

VSG Verify also offers a Master Screener Service, whereby all temps are screened to the same standard as your permanent employees, giving you peace of mind that all workers on your site have undergone the same level of background check. Q - Cleaning staff pose no risk to our business, why would I need to screen them?

A - Contract cleaners can pose one of the highest risks in business as they are often in buildings during hours when the office is not staffed. Cleaners are often unsupervised and can gain access to assets as well as confidential documents and computer files. Roles that are perceived as low-risk are routinely targeted by criminals as the path of least resistance to gain access to buildings and information.

Q - Do I need to run criminal record checks on all of my staff?

A - Criminal record checks are mandatory for a selection of specific roles including teachers, security guards, and doctors. They are also recommended for a variety of other roles including chartered accountants and individuals working in roles regulated by the Financial Services Authority. Criminal record checks are also required for all staff working Airside at UK airports.

These are just a small sample of roles demonstrating the point that there are three levels of UK Criminal Record Check available and it is vitally important to ensure that the correct check is requested – Basic, Standard or Enhanced Disclosure. There are also various ways to obtain the equivalent information from official sources overseas for candidates with non-UK residential background.

There is a wide variety of screening checks available and the most effective way to mitigate risk is to employ a package of checks that will target the specific risks that your business sector is exposed to. Q - I've checked all of my drivers when they joined the company, how can VSG Verify do anything to help?

A- Checking and taking a copy of your drivers' licences is no longer sufficient to show proper "Duty of Care" for any driver, whether they are driving company vehicles or driving their own vehicles on company business.

With the introduction of Government "Corporate Killing" legislation it is the business owner(s) who take the greatest risk of failing to ensure their driver’s entitlements.

Driving entitlements can change very quickly and you cannot rely on your employees keeping you up to date, especially if the change of circumstance potentially takes away the ability to carry out their duties. VSG Verify will be able to automatically schedule periodical checks on your drivers to ensure any changes that pose a threat to your business are highlighted to you so that you can take appropriate action.

Q - So why not keep screening in house?

Q -Do Employers have to provide references?

A - UK case law suggests that there is a moral obligation for employers to provide a reference, as failure to comply with reference requests could prevent candidates from securing a new job. Except for certain exceptions, employers are technically not legally obliged to give references, however if an employer provides a reference for one or more individuals they would be obliged to give references for all ex-employees in order to avoid claims of discrimination.

However, some regulated industries (for example financial services) specifically require employers to provide detailed references for certain roles.
